By accessing or using GetFunnelAI ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service.

1. Use of the Service

GetFunnelAI provides an AI-powered quiz funnel builder and lead collection platform. You may use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Service in any way that violates applicable laws or regulations.
• Collect personal data without appropriate consent from your end-users.
• Attempt to gain unauthorized access to any part of the Service or its infrastructure.
• Reverse-engineer, decompile, or disassemble any portion of the Service.
• Use the Service to transmit spam, malware, or other harmful content.

2. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately at [email protected] if you suspect unauthorized use of your account.

3. Subscription and Billing

Certain features require a paid subscription. Subscriptions are billed in advance on a recurring basis. You may cancel at any time through the billing portal. Refunds are issued at our sole discretion. We reserve the right to change pricing with reasonable notice.

4. Trial Period

New organizations may be offered a free trial. At the end of the trial, your selected payment method will be charged unless you cancel before the trial ends. Trial terms are displayed at sign-up and may vary.

5. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. You retain ownership of the lead data collected through your funnels. You grant GetFunnelAI a limited license to store and process that data solely to provide the Service.

6. Intellectual Property

The Service, including its design, code, and content, is owned by GetFunnelAI and protected by intellectual property laws. Nothing in these Terms transfers ownership of the Service to you. AI-generated funnel content is provided to you for your use, but GetFunnelAI makes no warranty about its originality or fitness for a particular purpose.

7. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

8. Limitation of Liability

To the maximum extent permitted by law, GetFunnelAI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits or data, arising out of or related to your use of the Service, even if advised of the possibility of such damages. Our total aggregate liability shall not exceed the amount you paid in the twelve months preceding the claim.

9. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for conduct that we determine violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the Service ceases immediately.

10. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the new Terms and updating the "Last updated" date above. Continued use of the Service after changes become effective constitutes your acceptance of the new Terms.

These Terms are governed by and construed in accordance with applicable law. Any disputes shall be resolved through binding arbitration or in the courts of competent jurisdiction, as required by applicable law.
